Parent Dies After Child

We’ll use the same family tree for all our detailed examples:


If Jane dies as a widow, with living and dead children:

  • If Jane dies after Charles, and Charles has no living heirs:
  • Charles’s share is disregarded.
  • Jane’s surviving children, Alfred, Bertha, and Doris, each get 1/3rd.

  • If Jane dies after Doris, and Nick and Liz are still alive:
  • Jane’s surviving children, Albert, Bertha, and Charles, get 1/4th each.
  • Jane’s grandchildren through Doris (Nick and Liz) split their mother’s share, and get 1/8th each.

  • If Jane dies after Charles and Doris, and Nick and Liz are still alive:
  • Charles’s share is disregarded.
  • Jane’s surviving children, Albert and Bertha, get 1/3rd each.
  • Jane’s grandchildren through Doris (Nick and Liz) split their mother’s share, and get 1/6th each.
